1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and PlayGo ("we," "us" or "our"), concerning your access to and use of the PlayGo website and application.

You agree that by accessing the site, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the site and you must discontinue use immediately.

2. Role of the Platform (Aggregator Status)

When you click "Book Now" or use a booking link provided on our platform, you are leaving PlayGo and entering into a direct contract with the third-party venue operator. PlayGo is not a party to that contract.

We are not responsible for the safety, quality, hygiene, pricing, or operational status of any venue listed. It is the sole responsibility of the parent or guardian to ensure the venue is suitable and safe for their children upon arrival.

3. Venue Operators & Business Claims

If you are a business owner utilizing the "Claim Venue" feature, you agree to the following:

• Authority: You warrant that you are the legal owner or authorized representative of the business.
• Accuracy: You are strictly responsible for ensuring that all information, including opening times, pricing, and availability, is accurate and up-to-date.
• Revocation: We reserve the right to revoke your "Claimed" status, edit your profile, or remove your venue entirely from the platform at our sole discretion, without notice, if we suspect fraudulent activity or receive continuous user complaints.

4. User-Generated Content & Reviews

Our platform allows you to post reviews, ratings, and comments. You retain ownership of your content, but you grant PlayGo a worldwide, perpetual, royalty-free license to use, reproduce, and display it.

When posting a review, you agree that your content will not:

• Be defamatory, abusive, offensive, or promote discrimination.
• Contain malicious code, spam, or unsolicited advertising.
• Be submitted by a competitor of the venue being reviewed for the purpose of malicious manipulation.

We reserve the right (but not the obligation) to monitor, edit, or remove any reviews that we determine, in our sole discretion, violate these Terms or are otherwise objectionable.

5. Limitation of Liability

Please read this section carefully as it limits our legal liability.

To the maximum extent permitted by applicable law, in no event will PlayGo, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or personal injury / property damage arising from your use of the site or visits to any venue listed on the site.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

6. Governing Law & Jurisdiction

These Terms shall be governed by and defined following the laws of England and Wales. PlayGo and yourself irrevocably consent that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
